Service

1. Bargainz.co.nz is an on-line service assisting New Zealand shoppers transact with New Zealand retailers and service providers ("Service"). You acknowledge that we may pay promotional commissions and other fees to affiliated service providers who may refer you to us and provide us with other services in respect of your use of the Service.
   
   
2. There is no charge for registering for the Service, only for advertising. By registering, you agree to the terms and conditions contained herein.
   
   
3. Bargainz.co.nz will take reasonable care to ensure that information provided by shoppers and retailers is accurately rendered online and to ensure the reliability of all other information provided. But it accepts no liability for any interruptions, faults or inaccuracies, nor any liability for any losses or damages, arising therefrom.
   
   
4. Bargainz.co.nz cannot guarantee that the Service will never be faulty or interrupted, but it will ensure that reported faults are corrected as soon as reasonably possible. If you believe a fault has occurred, you should report the fault by email to info@bargainz.co.nz.
   
   
5. Bargainz.co.nz may vary or suspend the whole or any part of the Service for any reason at any time at its sole discretion.

Usage

1. You agree to use the Service for lawful purposes only.
   
   
2. You agree not to use the Service:
   
   
   1. fraudulently or in connection with a criminal offence; or
      
      
   2. to send, receive, upload, download, use or re-use any material which is offensive, abusive, indecent, defamatory, obscene, menacing, or otherwise unlawful; or
      
      
   3. to cause annoyance, inconvenience or needless anxiety; or
      
      
   4. to send commercial advertising or promotional materials.
      
      
      1. Other than specifically in respect of your paid listing on the Bargainz website or any "Tell A Friend" functionality or promotion offered by Bargainz.co.nz.
         
         
3. You agree to tell Bargainz.co.nz immediately if anyone makes or threatens to make any claim or issue legal proceedings against you relating to your use of the Service and you must, at our request, immediately stop the act or acts complained of. You must confirm the details of the claim(s) in writing.
   
   
4. If you are in breach of any of these terms, Bargainz.co.nz may suspend your use of the Service. If your use of the Service is suspended, Bargainz.co.nz will not process any further applications from you.
   
   
5. Bargainz.co.nz reserves the right to vary these terms and conditions at any time.

    

Security

1. Bargainz.co.nz will take reasonable steps to preserve the security of personal information.
   
   
2. Bargainz.co.nz will regularly review developments and best practices in security. Unfortunately, no data transmission over the internet can be guaranteed as totally secure. Accordingly, although Bargainz.co.nz strives to protect such information, Bargainz.co.nz cannot ensure or warrant the security of any information transmitted to or from our Web site.

Privacy

1. Bargainz.co.nz will only use or disclose information provided by you in the following circumstances:
   
   
   1. where information is required to be disclosed online for the purposes of the Service, or via "Tell A Friend" campaigns and online comments, or
      
      
   2. where Bargainz.co.nz believes that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for national security in the performance of their function; or
      
      
   3. where authorised, required or permitted by law to use or disclose the information; or
      
      
   4. we will from time to time disclose information provided by you to our related entities and our third party consultants who will use that information only for purposes directly associated with administering and monitoring the Service. We may also from time to time use information provided by you for the purposes of advising you of special features of the Service.
      
      

   By agreeing to these terms and conditions you expressly consent to the above uses and disclosure of information provided by you.

1. The Service is accessed via the Worldwide Web, which is independent of the Service. Bargainz.co.nz is not responsible or liable for your use of the Worldwide Web, which is governed by your contract with your internet service provider.
   
   
2. Other than as previously stated in these terms and conditions, Bargainz.co.nz does not provide any warranties as to the accuracy or otherwise of the information that it provides as part of the Service.

Governing Law

 

1. These terms and conditions shall be governed by and construed in accordance with the law of New Zealand, and you submit to the jurisdiction of the courts of New Zealand for all purposes in connection with the Bargainz Web site and its services.
